DISTANCE SALES AGREEMENT
ACCOMMODATION SERVICES DISTANCE SALES AGREEMENT
Subject and Scope
http://www.asfiyaseaviewhotel.com/ (“Website”) has been prepared and made available for use for Asfiya Sea View Hotel, operated by Mulberry Turizm Eml. İnş. Tic. Ve San. Ltd. Şti.
Mulberry Turizm Eml. İnş. Tic. Ve San. Ltd. Şti. (“Company”) provides hotel reservation services through the Website and/or directly via telephone, e-mail or similar communication channels, in accordance with the provisions set out in this Accommodation Services Distance Sales Agreement (“Terms of Sale” or “Agreement”) and the Website’s Terms of Use.
Parties
This Agreement is concluded between Mulberry Turizm Eml. İnş. Tic. Ve San. Ltd. Şti. (“Company”) and the person who makes a reservation via the Website or directly through the Hotel via telephone, e-mail or similar communication channels (“Customer” or “Service Recipient”).
The Customer declares and undertakes that they are over 18 years of age, have full legal capacity, and are authorised to make reservations on their own behalf or on behalf of other guests.
Service Description
The Website enables Customers to make reservations for Asfiya Sea View Hotel.
These Terms of Sale govern the contractual relationship between the Customer and the Hotel.
The Customer declares that, regardless of the booking channel used, they have read and accepted this Agreement and the Terms of Use.
Hotel Information
The accommodation service subject to this Agreement is provided by:
Asfiya Sea View Hotel
(hereinafter referred to as the “Hotel”)
Service Information
The main characteristics, pricing and service details of the Hotel are presented on the Website.
Images and descriptions on the Website are for informational purposes only. Variations may occur due to renovations, furniture changes or updates.
Accommodation Conditions
Check-in time is 15:00 and check-out time is 12:00.
The Customer agrees to comply with these times. Early check-in or late check-out may be subject to additional charges.
The Customer is required to present valid identification upon arrival. The Customer shall be solely responsible for any incorrect or incomplete information provided.
Pets are not allowed at the Hotel.
Duration of the Agreement
This Agreement enters into force upon confirmation of the reservation by the Hotel and remains valid until the completion of the service.
Reservation Process
The Customer is responsible for providing accurate and complete information during the reservation process and accepts responsibility for the accuracy of such information.
The Customer confirms that they have reviewed and accepted all relevant contractual and informational texts prior to completing the reservation.
The Hotel reserves the right to refuse or cancel reservations in cases of unusual booking patterns or previous disputes.
Payment and Invoicing
The Customer is obliged to pay the service fee at the time of reservation or in accordance with the applicable reservation terms. Prices include VAT.
The Website is protected by SSL encryption. All payments are processed through secure payment systems.
The invoice is issued at check-out or sent via e-mail.
Payment and Cancellation Terms
Non-Refundable Reservations: 100% of the total accommodation amount is charged at the time of booking. These reservations cannot be cancelled and are non-refundable under any circumstances.
Flexible Reservations: 30% of the total accommodation amount is charged as a prepayment at the time of booking.
Cancellations made 14 days or more prior to the check-in date will receive a refund of the amount paid.
Cancellations made less than 14 days prior to the check-in date will be charged 100% of the total accommodation amount and no refund will be made.
The Customer agrees and undertakes to pay the remaining balance once the cancellation period has expired.
Payment may be made via credit card or bank transfer.
In the event that the payment obligation is not fulfilled, the Company reserves the right to pursue legal action.
If the Customer withdraws from the service after check-in for reasons not attributable to the Hotel, no refund shall be made.
Personal Data
The Customer accepts that their personal data will be processed in accordance with Law No. 6698 on the Protection of Personal Data.
The relevant Disclosure Text and Cookie Policy are available on the Website.
The Company will never request credit card information via e-mail. Any such requests should be considered fraudulent.
Force Majeure
Events such as natural disasters, pandemics, war, strikes or technical failures shall be considered force majeure.
In such cases, the Hotel reserves the right to modify or cancel the service. The Hotel shall not be held liable in such circumstances.
Other Provisions
The Hotel reserves the right to change prices, refuse reservations or cancel bookings in the event of system errors.
The Company shall not be held liable for pricing errors published on the Website.
Dispute Resolution
This Agreement shall be governed by Turkish Law.
Antalya Courts and Enforcement Offices shall have jurisdiction over any disputes arising from this Agreement.
